Michael Gagnon, an Albany Plumber, was injured when he fell from a ladder during the construction of the Homes 2 Hotel off of Wolf Road on December 5th, 2014. Gagnon suffered a torn meniscus in the left knee, which required surgery and may result in the need for a knee replacement in the future. The Defendants were sued for violations of NYS Labor Law Section 240(1), which imposes absolute liability on Owners and General Contractors for failing to provide a safe place to work in relation to elevation-related accidents. The matter settled following depositions and several months prior to trial.
